Terms of Service

1. Scope
These Terms of Service ("Terms") govern the use of the wine-pairing.online platform (website, progressive web app and native mobile apps, together the "Service"), operated by MYSYMP AG, Switzerland ("we", "us"). By using the Service you agree to these Terms. The German "AGB" apply to B2B customers with a signed business subscription; in case of conflict for B2B customers, the AGB prevail.
2. The Service
wine-pairing.online provides AI-generated wine recommendations for dishes ("Henri, the AI sommelier"), a wine and grape-variety knowledge base, a digital wine cellar and, for business customers, a QR-code sommelier for their own wine list. Recommendations are generated automatically and are provided for inspiration and entertainment; they do not constitute professional, medical or nutritional advice.
3. Free use and Pro plan
Core wine pairing is free of charge and does not require registration. Optional paid plans ("Pro") unlock additional features such as unlimited recommendations and the full digital cellar. Purchases made inside the iOS app are processed via Apple In-App Purchase and are subject to Apple's terms; purchases on the web are processed by our payment provider. Subscription prices, terms and cancellation options are shown before purchase.
4. Accounts
Some features require an account. You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. You may delete your account at any time; this deletes your personal data in accordance with our Privacy Policy.
5. Responsible enjoyment
The Service relates to alcoholic beverages and is intended for users of legal drinking age in their country of residence. Alcohol-free alternatives are labelled as such (de-alcoholised wines may contain up to 0.5% ABV). Please drink responsibly.
6. Acceptable use
You may not misuse the Service, in particular: no automated scraping or bulk extraction of content, no attempts to disrupt or reverse-engineer the Service, no unlawful, misleading or infringing content in user submissions (e.g. wine lists, photos), and no use of the AI features to generate unlawful content.
7. Content and intellectual property
All content of the Service (texts, methodology, design, databases, trademarks such as "Henri") is protected and remains our property or that of our licensors. Business customers retain rights to the wine lists and materials they upload and grant us the licence necessary to operate the Service (see AGB, section 3). AI-generated recommendations may be used for personal, non-commercial purposes.
8. Availability and changes
We operate the Service with reasonable care but do not guarantee uninterrupted availability. We may modify, extend or discontinue features, and may update these Terms; material changes will be announced in the Service. Continued use after changes take effect constitutes acceptance.
9. Liability
To the extent permitted by law, we are liable only for damage caused intentionally or by gross negligence. We are not liable for the accuracy of AI-generated recommendations, third-party content (e.g. partner wine lists) or for indirect and consequential damages. Mandatory statutory liability remains unaffected.
10. Privacy
The processing of personal data is described in our Privacy Policy (wine-pairing.online/datenschutz). We process data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR.
11. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules. Exclusive place of jurisdiction is the registered seat of MYSYMP AG, Switzerland, unless mandatory consumer-protection law provides otherwise.
